Definitions

On this Terms and Conditions page the following definitions are observed:
Dizzybee means J-Touch Pty. Ltd. trading as Dizzybee.
WEBSITE means the website that is proposed, being developed, or has been produced by Dizzybee for YOU.
DOMAIN NAME REGISTRAR means a company separate to Dizzybee through which Dizzybee will register your domain name on your behalf. Dizzybee has no control or influence regarding this company and is not responsible for the quality or cost of services or products provided by this company. Dizzybee does generally use a company which has provided good service in the past at a competitive price.
HOSTING PROVIDER means a company separate to Dizzybee through which Dizzybee will organise a hosting environment for your website. Dizzybee has no control or influence regarding this company and is not responsible for the quality or cost of services or products provided by this company. Dizzybee does generally use a company which has provided good service in the past at a competitive price.
SOFTWARE means computer program code that is used to deliver the website. This may include modules or components from various sources and associated documentation or support files in an electronic or printed form.

Copyright and Content

  • Any image or text supplied to DizzyBee must follow Australian copyright laws. It is up to you to check that your content is not breaching any copyright. This could mean observing the copyright laws of other countries should any of your content be derived from those sources. You should cite any sources of content that is not yours.
  • Except where it applies to the above, all content on any website produced by Dizzybee is yours. You own the copyright and any intellectual property.
  • Dizzybee accepts no responsibility for content published on your website.
  • As the website is generally a content management system which provides the ability to control whether the content is published or not, Dizzybee accepts no responsibility for content that resides in the system but is not published.

Text and Information

  • All pages in the website are based on a single theme – i.e., all pages have the same basic design and layout (including menus) and just the main content of the page is different, not the style.
  • All text for pages must be supplied in electronic format and will be used ‘as is’. This information needs to be supplied before the commencement of the website begins.
    We do not proofread the supplied documents. It is up to you to check the information supplied is true and correct. We take no responsibility for grammar, spelling, typos or incorrect information.
  • Suggestions and advice will be given based on our experience in the industry for the content on the website, however, ultimately it is up to you to supply all content.

Images

  • All images used in the site, must be supplied and used ‘as is’. If you require the images to be modified in some way i.e. cropped, background made transparent, an additional charge will be incurred (see below).
  • We may scale your images to make them more suitable for use on a web page, however, this does not change the image except for its size.
  • If you require images, then we suggest you look at the following websites to find something that will suit your requirements.  These purchasing of these images usually come with royalty restrictions.  Please read the site specific Terms and Conditions.  We can advise you if you are unsure of how the images can be used.

Payment

  • An deposit, which varies depending on domain type and registration, is required before work will commence on your site. This is used to secure registration of the domain name with a domain name registrar and web hosting with a web hosting company.
  • The remaining balance is required to be paid prior to the website being deployed. After this is done all passwords will be handed to you.

Passwords

  • It is your responsibility to keep your passwords safe. They will be required for any maintenance work on the site by us (or anyone else). You can change the passwords if you wish. We recommend the use of KeyPass password safe for holding all of your passwords. If you are using a Mac, try KeePassX. If you do misplace them they can always be reset by the system hosting the site.

Domain Name Registration

  • Should you request, Dizzybee will employ the services of a domain name registrar for registering your domain.
  • If you require additional domain names registered e.g. .com, .org, .net, you will incur an additional charge to cover this which will vary depending on the number of additional domain names and the types of domains. You will be informed of the charge before proceeding.
  • If your required domain name is unavailable i.e. [yourcompanyname].com.au, an appropriate replacement name will be discussed and agreed upon before proceeding.
  • We suggest that the availability of the domain may have an influence on your choices of name for products, services, etc, rather than the other way round.

Website Hosting

  • Should you request, Dizzybee will employ the services of a website hosting provider to host your website. This company could be the same as the domain name registrar. Many companies offer both services.
  • Your website needs to be served from a computer somewhere on the Internet.
  • The hosting provider will ensure that when someone types your domain name or clicks on a link containing your domain name it goes to that computer.
  • The hosting company’s computers, unlike your home computer (or mine), is much more reliable and powerful ensuring reliability and speed.

Website Maintenance

  • Dizzybee can provide support and maintenance of your website should you require it from time to time. There will be an additional charge depending on the work required.
  • If you choose to perform any changes to the website outside the provisions of the website itself for editing and publishing content then Dizzybee accepts no responsibility for the effects of those changes. The same applies if you employ the services of anyone else to perform changes. Changes includes, but is not limited to, changes to the software code or the configuration of the software that comprises the delivery mechanism for the content of the website; changes to the files that control the style or look and feel of the website; changes to the webserver configuration; changes to the hosting environment; changes to the way that the domain name is resolved, redirected or otherwise interpreted; any other changes that cause the website to behave in an unexpected manner.

Warranties and Liability

  • As we guarantee satisfaction for your website, if you are not completely satisfied with your design and we cannot come to an alternative arrangement, your money will be returned to you (minus the charges incurred for domain name registration and web hosting – however, these will be yours to keep).
  • You are not obliged to continue using Dizzybee for you website maintenance or support or for any other work, however these terms and conditions will still apply to any website that Dizzybee has created for you under these terms and conditions.

The Plug

  • We require that you keep the link back to Dizzy Bee Web Design located on the bottom of your pages. We too will have a link from our site to yours.
